The camp of the woman-complainant in the two cases of Aggravated Acts of Lasciviousness filed an application for Hold Departure Order (HDO) against popular actor Tony Labrusca on October 15, 2021.
Through her lawyer, Atty. Regie Tongol, the complaint cited in the Motion that Labrusca was a no-show in the August 4, 2021 hearing, but was seen partying with several Philippine personalities a few days after and then flew off to the U.S. Atty. Tongol said ‘Respondent Labrusca’s refusal to attend the August 04, 2021 preliminary investigation clearly shows his indication that he does not respect the processes of the Honorable Office, much more, of the country. It further reflects his blatant disregard of the justice system in the Philippines just because he is a model and actor with a foreign passport’.
The motion showed several IG posts of Labrusca showing that he was en route to the U.S. and partying there. Atty. Tongol equated these actions of Labrusca to ‘a high probability to evade arrest, to be a flight risk, and that he has enough resources to depart the country at his whim’. He further stated that ‘Respondent is facing a serious crime against one of the country’s citizens and he should not be allowed to get away with it with impunity just because of his fame and fortune’.
According to him, given that the cases are awaiting decision of the Makati City Prosecutor’s Office headed by City Prosecutor Dindo G. Venturanza, the cases would already be forthcoming and ‘The respondent should not be allowed to evade arrest by easily flying off at a moment’s notice as he had already done’.
The case was first assigned to be investigated by Assistant Prosecutor Victor Aguba. However, he was appointed recently as an RTC judge and the resolution of the case is now with Assistant Prosecutor Marc Jeremiah Garcia.
